1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Starthack.io Pvt Ltd ("Company," "we," "us," or "our"), a company incorporated under the laws of India, governing your access to and use of the Starthack.io platform, including all associated websites, applications, AI evaluation engines, and related services (collectively, the "Services").

By accessing, browsing, or using the Services in any manner, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms in their entirety, you are prohibited from accessing or using the Services and must immediately discontinue use.

2. Description of Services

Starthack.io is an AI-powered candidate evaluation platform designed for individual professionals seeking to assess their interview readiness. The Services comprise:

  • Automated resume parsing and analysis (PDF upload)
  • AI-generated alignment reports measuring role fit, skill depth, and credibility
  • AI voice interviews with adaptive, resume-specific questioning
  • Personalised interview preparation plans based on evaluation findings
  • Shareable evaluation report links for optional disclosure to employers

The Company reserves the right to modify, suspend, or discontinue any component of the Services at its sole discretion, at any time, with or without prior notice.

3. Eligibility & User Accounts

3.1 Eligibility

You must be at least eighteen (18) years of age and possess the legal capacity to enter into binding contractual agreements under applicable law. By using the Services, you represent and warrant that you satisfy these eligibility requirements.

3.2 Account Creation

Access to the Services requires authentication via Google or GitHub OAuth. By creating an account, you agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your authentication credentials
  • Accept full responsibility for all activities conducted under your account
  • Notify us immediately of any unauthorised access or security breach

3.3 One Account Per Individual

Each User is permitted one (1) account. The creation of multiple accounts to circumvent daily evaluation limits, payment obligations, or scoring mechanisms constitutes a material breach of these Terms and may result in immediate suspension or permanent termination without refund.

4. Acceptable Use Policy

You shall use the Services solely for lawful, personal career preparation purposes in accordance with these Terms.

4.1 Prohibited Conduct

You expressly agree NOT to:

  • Submit false, fabricated, or materially misleading resume content
  • Upload documents containing malicious code, prompt injections, or adversarial content
  • Attempt to reverse-engineer, manipulate, or circumvent evaluation algorithms
  • Share or misrepresent evaluation reports to deceive employers or third parties
  • Scrape, crawl, or programmatically extract data from the platform
  • Use automated bots, scripts, or tools to interact with the Services
  • Interfere with or disrupt the platform's infrastructure or availability
  • Impersonate any person or create accounts on behalf of others

4.2 Resume Submissions

When uploading a resume or CV, you represent and warrant that:

  • The content is your own work or you have proper authorisation to submit it
  • It does not contain confidential or proprietary information of third parties
  • It does not infringe upon any third-party intellectual property rights

The Company bears no liability for legal disputes arising from content you submit.

5. Payments & Refunds

5.1 Pricing

The AI voice interview is a paid feature. Pricing is displayed at the point of purchase and is subject to change with reasonable prior notice. The resume evaluation component is available at no cost subject to daily limits.

5.2 Payment Processing

All payments are processed securely via Razorpay. The Company does not store, access, or retain your card details, UPI credentials, or banking information. Payment is charged at the time of purchase.

5.3 Refund Policy

  • Evaluations are non-refundable once AI processing has commenced
  • In the event of a verified platform-side technical failure preventing completion, contact support within seven (7) days for review
  • A one-time complimentary re-evaluation may be granted for confirmed platform errors (excluding User device or connectivity issues)
  • You are responsible for applicable GST or other taxes based on your jurisdiction

6. AI-Generated Content & Limitations

The Services employ artificial intelligence and machine learning systems to evaluate resumes, conduct voice interviews, and generate reports. By using the Services, you expressly acknowledge and agree that:

  • AI evaluations are probabilistic in nature and may contain inaccuracies or omissions
  • Evaluation scores are preparatory benchmarks, not guarantees of employment outcomes
  • The Company makes no representation that use of the Services will result in job offers, interview invitations, or career advancement
  • AI interview questions are derived from your submitted materials — inaccuracies in your resume may be directly probed
  • Evaluation criteria and scoring methodologies are subject to evolution as our models improve

7. Intellectual Property Rights

7.1 Platform IP

The Starthack.io platform — including its design, algorithms, scoring systems, source code, AI models, and all associated content — is the exclusive property of Starthack.io Pvt Ltd, protected under Indian and international intellectual property law. You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for their intended purpose.

7.2 User Content Licence

By submitting content to Starthack.io, you grant the Company a worldwide, non-exclusive, royalty-free, perpetual licence to:

  • Process and analyse your content to deliver the Services
  • Generate evaluation reports and preparation plans
  • Use anonymised, de-identified data to train and improve AI models

7.3 Your Report

Your evaluation report belongs to you. Sharing is entirely at your discretion via the private share link. The Company shall not distribute your identified report to employers or third parties without your explicit, voluntary action.

8. Data Privacy

The collection, use, storage, and protection of your personal data is governed by our Privacy Policy, which is incorporated herein by reference. Key provisions include:

  • Authentication via OAuth — we never store third-party passwords
  • Anonymised evaluation data is used for AI model training
  • Razorpay handles all payment data under PCI-DSS standards
  • Data encryption in transit (TLS) and at rest (AES-256)

9. Disclaimers & Limitation of Liability

9.1 Disclaimer

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF AI-GENERATED RESULTS.

9.2 Limitation

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, STARTHACK.IO PVT LTD, ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, EMPLOYMENT OPPORTUNITIES, OR REVENUE, ARISING FROM YOUR USE OF OR RELIANCE ON THE SERVICES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Starthack.io Pvt Ltd, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your violation of these Terms or applicable law
  • Submission of false, infringing, or unauthorised content
  • Misrepresentation of evaluation results to third parties
  • Any third-party claims arising from your use of the Services

11. Termination

The Company reserves the right to suspend or permanently terminate your account, with or without notice, at its sole discretion, for reasons including but not limited to:

  • Violation of these Terms or platform policies
  • Fraudulent, illegal, or abusive conduct
  • Non-payment or payment disputes
  • Creation of multiple accounts or gaming of evaluation systems
  • Conduct deemed harmful to the platform, other Users, or the Company

Upon termination, your right to access the Services ceases immediately. Provisions that by their nature survive termination — including intellectual property rights, disclaimers, indemnification, and limitation of liability — shall remain in full effect.

12. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by and construed in accordance with the laws of India, including the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023, and the Indian Contract Act, 1872.

Dispute Resolution

Disputes shall first be addressed through good-faith negotiation. If unresolved within thirty (30) days, disputes shall be settled through binding arbitration under the Arbitration and Conciliation Act, 1996, with proceedings held in Dehradun, Uttarakhand, India.

13. Changes to Terms

The Company reserves the right to amend these Terms at any time. Material changes shall be communicated via email or platform notification at least thirty (30) days prior to taking effect. Your continued use of the Services following the effective date constitutes acceptance of the revised Terms.

14. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding Starthack.io.

Severability: If any provision is found unenforceable, the remaining provisions shall continue in full force and effect.

No Waiver: Failure to enforce any right shall not constitute a waiver of that right.

Assignment: You may not assign or transfer your rights without our prior written consent.

Force Majeure: The Company shall not be liable for failures caused by circumstances beyond reasonable control, including internet outages, third-party service failures, or acts of God.
